CUSTOM LOTS UNDER CONSTRUCTION - EROSION CONTROL

The 2006-2007 rainy season runs from October 1, 2006 through April 30, 2007.  As set out in Article VIII, Section 27, Page 123 of the Shady Canyon Master Declaration of Covenants, Conditions and Restrictions (the “CC&R’s”), each lot owner is required to maintain “Best Management Practices” to ensure that erosion control measures are taken pursuant to the Water Quality Management Plan for the Shady Canyon community and to comply with the requirements of the State Water Resources Control Board General Permit for Construction.  Best Management Practices is defined in Article 1, Section 4, page 6 of the CC&R’s, and are designed to mitigate soil erosion and runoff and include, but are not limited to: a) sandbagging all areas where dirt meets pavement, curbs or gutters, b) hydro-mulching all exposed portions of the lot and c) maintaining the on-site sediment control basin.  

Best Management Practices is a requirement of the City of Irvine.  Under the Best Management Practices, it is required that your lot be sprayed with a hydro-mulch in order to stabilize the dirt on the lot, eliminating the need to sandbag the entire perimeter of the lot.  However, once you begin grading your lot, the hydro-mulch will be disturbed and you will need to place sandbags along the perimeter of your lot during the rainy season, and all construction material (e.g.,. bags of cement, stucco) must be covered and/or contained from coming in contact with water.  Driving vehicles on the lot will also disturb the hydro-mulch, reducing its effectiveness, therefore it is required that you install a gravel driveway approach.  Sandbags shall also be placed around the sediment control basin.  The sediment control basin will need to be maintained during the entire rainy season to make sure it is draining properly.  As the sandbags deteriorate or break, you will be required to have them replaced.  Additionally, sandbags shall be placed along the edge of lots that interface with curbs and gutters. 

 You may either hire someone to complete this work or do it yourself utilizing your on site construction firm.  In either case you must provide a 24 hour emergency contact number for the City and the Association in case of storm related emergency work or storm clean up work is required.  You should have just recently received a letter with the form that you need to fill out and send in.  The work shall be performed as required during and after the storm regardless of weekends and/or holidays.  If this work is not properly executed, you may be fined by the City of Irvine for failure to provide Best Management Practices (BMP's) as it relates to water  quality and dust control.

In the event that your lot is not controlled adequately during or after a storm, the Association will mobilize a contractor if it is necessary to prevent damage to neighboring properties, streets and common areas, or to protect water quality.  In this case, you will be charged time and material plus an additional 40% surcharge for emergency response work. 

Additionally, if you are beginning construction or are currently under construction, you and your general contractor must comply with the National Pollutant Discharge Elimination System General Permit No. CAS000002 (the “General Permit”) issued by the Santa Ana Regional Water Quality Control Board (the “Regional Water Board”).  The General Permit establishes requirements for discharges of storm water and drainage runoff associated with construction activity and requires that you and/or your general contractor (a) file a “Notice of Intent" to comply with the General Permit and (b) prepare a "Storm Water Pollution Prevention Plan" to address erosion, sediment, runoff, construction pollutants and other issues during construction of improvements on your lot.  To obtain further information regarding these requirements, please refer to the General Permit, which can be found on the Internet at www.swrcb.ca.gov/stormwtr/docs/finalconstpermit.pdf. CUSTOM HOME MAILBOX SPECIFICATIONS

To reflect the current United States Postal Service (USPS) specification for the Custom Mailboxes at Shady Canyon, the Design Guidelines section on Mailboxes, page 86, is being revised to the following: 

  • The face of the mailbox shall be located so it is right against the curb.  
  • The height from the bottom of the curb to the bottom of the receptacle shall be 42".  The maximum is 48”.
  • Mailboxes shall be 24” to 30” wide by a maximum of 60” high.
  • Mailboxes shall match the architectural style of the house.
  • If a lock is used on a mail receptacle, the receptacle must have a slot large enough to accommodate the normal daily mail volume.

PARKING PLAN FOR PHASE I, TRACT 15941

Attached you will find a parking plan for Phase I, Tract 15941 that shows what sides of the street are designated as No Parking Zones and what sides of the street vehicles can park on. Please inform guests and contractors which sides of the street they can park on. The roving patrol will help to enforce the street parking and issue citations to those vehicles that are parking in No Parking Zones. Seeing as there are several residences that have been completed on Blue Heron and Black Hawk in this phase, please be courteous and try not to park in front of them. Thank you!

ADD TEMPORARY/PERMANENT GUEST GATE ACCESS:

The GateWorksGuest.com system allows residents access to update and edit their personal guest information via the Internet rather than faxing a list to the gate. At this time there is no limit to how many temporary and permanent guests you can include on your gate access form.

When you go online to www.gateworksguest.com/community.php, select Shady Canyon from the "Available Community" pull-down menu. You will then come to a screen that asks for your phone number and password.  You will need to enter your ten digit phone number which includes your area code.  Do not include the parentheses or dashes, just numbers such as 9497251234.  Your password should be the password that you wrote on your gate access form. 

If you cannot remember your password, please call the gate or management to verify what your password is and type it in lower case.  At the top of the next page you will see home, settings, guests, contacts, history and logout.  Click on guests and from here you can add or delete new temporary or permanent guests.  Please contact management at 949-838-3250 if you have any questions.

PATIO/BBQ AREA/RECREATIONAL FACILITY

The recreation facility is ready for homeowners to reserve for parties and special events. The patio/BBQ area and recreation facility must be rented together as a package and will not be rented seperately. The Board is proposing to increase the rental fee for the patio/BBQ area and recreation facility from $100.00 to $300.00 since both areas must be rented together. Any residents can use the patio/BBQ area at anytime without a reservation for small groups but please keep in mind that if that area is reserved, it will not be available to you. Homeowners have 30 days to comment on this change and the Board will take all comments into consideration before adopting the new fee at their October 3, 2007 meeting.  The refundable deposit will remain at $1,000.00.  Currently these fees are stated in the Rules & Regulations, however will be removed from the Rules & Regulations and only reflected on the rental application.  Management will only accept checks payable to Shady Canyon.  If you would like to reserve the recreation facility/patio/BBQ area, please contact Valerie at 949-838-3246.  You can also obtain a rental application from the website under Forms. You will have to check out the key and return it to the recreation facility at the west gate and you need to enter/exit the facility through the side door near the pool gate and not through the front double doors. For your convenience please find a copy of the new rental application.

TIMELY REMINDERS

  • Homeowners, when you need an additional transponder or a replacement transponder you can go to the west gate and obtain them there. Please, pay by check and make it payable to Shady Canyon Community Association. The gate attendants will not accept cash.
  • Homeowners need to remind their contractors that all construction/deliveries must enter the community through the east gate.
  • Residents should keep their pets on leashes when walking them and please pick up after them.

FRONT YARDS IN THE VILLAS

Please keep in mind that the front yards in the Villas are maintained by the Association. Homeowners shouldn't be watering their front yards, removing plant material, installing plant material, etc. If you have a concern about your front yard, such as it not being watered enough, being over watered, bare areas, diseased/dead plant material, lack of detail please contact Shana Aaberg at Keystone Pacific Property Management at 949-838-3286 or saaberg@keystonepacific.com .

She will fax a work order request to the landscaping company. The landscaping company will respond back to her and she will respond back to you. The plant material that is in your front yards is drought tolerant and does not require a lot of water so if you are also watering your front yards, you may be damaging plant material and may be responsible for replacement of it if it dies due to over watering.

If you do not like the plant material in your front yard and would like to make a change, please contact Sherry Salazar, the architectural coordinator at (949) 718-4900 Ext. 18 and she will explain to you that you will need to draw up a plan showing what kind of plant material and how many of each you would like to replace your current plant material with and it would need to be approved by the Design Review Committee (DRC). You would be responsible for paying to change your front yard and it would need to be installed by Valley Crest Landscape Maintenance, the Association's landscaping company.

GATE SYSTEM

The gates at the East Entry, West Entry, Copper Creek, Sage Creek and future Canyon Creek have all been changed from the existing system to a new system. Along with the change in systems come new transponders. The new transponders are approximately the same size as the ones you currently have. However, the new devices need to be affixed to your windshield in order to allow the system to read them.

The following answers some questions regarding the new transponders and access system:

Question: Is there a limit to the number of transponders I can have?
Answer: Each household will receive two transponders free of charge. Additional transponders will cost $55.00 each, just as with the existing transponder system.

Question: Can I transfer my transponder from vehicle to vehicle?
Answer: No. The transponder is registered to a specific vehicle. If it is removed from the windshield of your vehicle for any reason it will become deactivated. If this happens, you will need to return the transponder for an exchange and a new transponder will be installed for a fee of $55.00.

Question: What if I don?t want a transponder on my vehicle - will my old transponder work?
Answer: Your old transponder will work. With the new system fully operational, if you chose not to have a transponder installed you will need to use the guest entry lane.

Question: What happens when I buy or sell a vehicle?
Answer: You will need to remove the transponder from the old vehicle and replace it with a new one when you register the new vehicle with Keystone Pacific Property Management. The cost for this replacement is $55.00.

Question: What if my vehicle and/or transponder are stolen?
Answer: Notify Keystone Pacific Property Management immediately. Any lost or stolen transponders will be subject to a $55.00 replacement fee.

Question: What if I move out of Shady Canyon?
Answer: Return your transponder to Keystone Pacific Property Management when you move or ensure that your deactivated transponders are transferred through escrow to the new owner. The new owner will need to bring them in to have them activated and placed on their vehicles.

Question: Will the new transponder interfere with the GPS system in my car?
Answer: No. The frequency of the new transponder should not affect your GPS system.

Question: What do I do if my car is in the shop for repairs and I am using a rental car or borrowing a vehicle from family or friends?
Answer: If you do not have your vehicle (with the transponder on it) you will need to use the guest lane and show identification to enter the Community.

The Board of Directors would like to thank Integrated Electronics Management (IEM) for its assistance in making this change. IEM is expected to operate in a highly professional manner with minimum disruption to the Community.

The Shady Canyon Golf Club is for members only and is not an amenity of the Association. However, social memberships are available for residents of the Community so they may be able to benefit from the fantastic facilities provided there.
